Constitution of the Jersey City Marine Corps Association

Article I Name

 

            This organization shall be known as the J.C.P.D. Marine Corps Association, Incorporated, of the Police Dept. of the City of Jersey City.

 

Article II  Purpose and Objectives

 

Section A  Purpose

        

            This is an organization of active and retired members of the Jersey City Police Department who are active or former members of the United States Marine Corps, organized to promote the general welfare of the membership through moral, intellectual, and social cooperation and to maintain our interest and affiliation with the United States Marine Corps. 

 

Section B  Mission/Objectives

 

            The primary objectives of the association are as follows:

                  - To foster the esprit di corps and preserve the traditions of the Marine Corps throughout the JCPD/Marine Corps family.

                  - To support deployed officers (regardless of branch of service) and their families while they serve on active duty and to continue                            that support as needed while they transition back to civilian life.

                  - To continue our proud history of service by giving our support to worthy causes including, but certainly not limited to, Toys for Tots,                      The Wounded Warrior Project, and Marines Helping Marines.

                  - To honor those men and women who have made sacrifices in the line of duty and to fraternally support members of our military                          and law enforcement family.

                  - To encourage professional and social networking amongst Marines currently serviing as sworn law enforcement officers/agents in                      various local, county, state, and federal agencies so that we may assist eachother in any way possible, carrying on the tradition and                      spirit of "Semper Fidelis".

 

Article III Membership

 

Section A   Application for Regular Membership

 

         Regular membership shall be open to active and retired sworn law enforcement officers who are serving or have served honorably in the United States Marine Corps or as "green side" corpsmen in the United States Navy.

 

Section B Associate Membership

 

            Associate membership shall be open to active and retired fire and EMS personnel who are serving or have served honorably in the United States Marine Corps or as "green side" corpsmen in the United States Navy.

 

Section C Honorary Membership

 

            Persons may be nominated for honorary membership by any regular member in good standing.  A vote will be conducted amongst the regular membership and if the majority approve, the nominated person(s) shall be granted honorary membership.

 

Section D  Proof of Service

 

            Persons seeking regular or associate membership status must be willing and able to provide to the President upon request proof of service in the form of an official agency identification and a DD214 (or other such document showing military service) in order to show that they meet the requirements for membership as set forth in sections A and B above.

 

Article IV  Officers

 

Section A   The Board of Officers shall consist of the following positions:

 

            1.  President/Commandant

            2.  Vice President/Vice Commandant

            3.  Recording Secretary

            4.  Treasurer

            5.  Sergeant at Arms

 

Section B  Election of Officers

 

            1 Elections

                        The officers of the association shall be elected on the date of the October meeting and shall hold office for a term of one year.                               Change of command will be conducted at the November meeting (the Marine Corps Birthday Celebration). 

 

            2 Eligibility to Vote

                        Only regular members in good standing shall be eligible to vote and hold office.

 

            3 Vacancy in Elective Office

                        Whenever an elective office becomes vacant for any reason during the course of the term, the President/Commandant shall                                 appoint a member in good standing to fill the position for the remainder of the Term.  In the case that the office of President is                               vacated, the Vice President will fill the position for the remainder of the term. 

 

            4 No Contest for Office

                        When there is no contest for any elective office, the President shall direct the Secretary to cast one ballot for the candidate(s)                                 nominated.  The candidate(s) shall then be declared to have been duly elected.

 

Article V  Duties of Officers

 

Section A  President

 

            The President shall:

                        - Inform, advise, and report to the Membership on all matters of mutual concern in furthering the Association's interest

                        - Preside at all meetings of the associations and preserve order

                        - Direct that a vote be taken by the board of officers on all questions of business for the good of the organization

                        - Appoint committees

                        - Be authorized to sign checks as provided by Article V, Section D, Subsection 1.

                        - Conduct an audit of the financial records of the association annually

                        - Deliver to a successor all books, papers, records, and other organization property upon vacating office

 

Section B  Vice President

 

            The Vice President Shall:

                        - Assist and advise the President in carrying out the functions of the office

                        - Perform the duties of the President in the absence of the President

                        - Be authorized to sign checks as provided by Article V, Section D, Subsection 1

 

Section C  Secretary

 

            The Secretary shall:

                        - Record and preserve an accurate set of minutes of meetings

                        - Present and read to the membership communications, correspondence, minutes, and matters of interest as required.

                        - Conduct necessary correspondence

                        - Maintain an accurate listing of the names and contact information of all members

                        - Deliver to a successor all original books, papers, records, and property in his possession upon vacating the office

 

Section D  Treasurer

 

            The Treasurer shall:

                        - Deposit and invest funds and monies received in commercial and savings banks that are FDIC insured.  All transactions shall                               require the approval and signatures of the President and Vice President and/or Treasurer. The funds of the organization shall be                           placed in deposit in the name of JCPD Marine Corps Association

                        - Maintain a true and accurate recording of the finances of the association and present to the membership a monthly report

                        - Make payments for all bills presented and approved for payment; preserve all vouchers and invoices directing payment;                                         preserve all cancelled checks and documents relating to payments

                        - Have available at all times the books and records for inspection by the President and board of officers

                        - Deliver to a successor all original books, papers, records, and property in his possession upon vacating the office

 

Section E  Sergeant at Arms

 

            The Sergeant at Arms shall:

                        - Keep order at all meetings and insure that all members, visitors, and guests attending the meeting have the approval of the                                    presiding officer

                        - Oversee the tabulation of votes at all meetings

Article I   Order of Business

Article II   Meetings

 

            Regular and special meetings of the association shall be called to order with a quorum of members established by the Board of Officers.  The time and place of meetings shall be selected by the President, who shall direct the Secretary to provide notice to the membership in a timely manner.

 

Article III  Debate

 

            In order to encourage the free and open exchange of ideas and to promote expression of opinion in accordance with the democratic precess, the right to propose and debate any matter beneficial to the association shall be the privilege of any regular or associate member.

 

Article IV  Admissions

 

            Membership shall be granted to applicants in accordance with the rules/guidelines set forth in Article III of the Constitution of the JCPD   Marine Corps Association.

Article VI  Funds

 

     Section A  Depositories

 

            The funds of the association shall be deposited in an account in the name of the association in a commercial bank that is FDIC insured.

 

     Section B  Investments

 

            Whenever the investment or withdrawal of funds is deemed appropriate the president shall, with the the approval of the Board of Directors, direct the funds of the association to be invested or withdrawn by the Treasurer.

 

Article VII  Fiscal Expenses

 

         The Board of Officers shall approve authorized payment of any bills on behalf of the association.  Such bills will be submitted in writing to the treasurer for payment.

 

Article VIII  Charges

 

     Section A  Procedure

 

            Charges may be preferred by any regular member in good standing against another member for violation of the principles set forth in the constitution and by laws of the association.  They shall be specific, written and signed, and submitted to the President.  The President shall furnish a copy of the charges to the charged member  and present the charges at the next regular meeting of the association.

 

     Section B  Censure and Expulsion

 

            After due consideration of charges against a member and with the affirmation of at least 3 of the five officers, a vote will be held to either censure or expel the charged member (as recommended by the board).  With a two thirds majority of the members present at a meeting, the charged member censured or expelled from the association.

 

Article IX  Communications

 

         Correspondence relating to the official business of the association shall be written on official stationery and shall be signed by the President or an individual authorized by the President.

 

Article X  Parliamentary Procedure

 

         All questions of parliamentary law and questions not governed by the constitution and bylaws shall be governed by Robert's Rules of Order.  Any regular member shall have the right to appeal the decision of the presiding officer to the delegate body at a meeting.  A majority vote shall prevail.

 

Article XI  Amendments

 

         Any regular member in good standing may make a motion to amend, repeal, or revise the constitution and bylaws of the association and any provisions there in.  The motion will be discussed and put to the board of officers for a vote.  With a three fifths vote, the motion will be put to ALL regular members for a vote.  The motion shall/will pass with over a fifty percent vote.
